  • FINISCE L’INCUBO DEI TAMPONI E DELLE MASCHERINE

    Il Ministero della “Salute” non ha avuto il coraggio di rinnovare ancora una volta l’assurda ordinanza del 28 aprile 2023, prorogata fino al 30 giugno 2024, che imponeva l’uso delle mascherine e l’effettuazione dei tamponi PCR per l’accesso alle strutture sanitarie. A partire da oggi, quindi, qualsiasi medico od operatore sanitario che dovesse chiedere ad un paziente di sottoporsi al tampone o di indossare una mascherina opera illegittimamente e commette reato.
    Ricordiamo brevemente le norme che disciplinano i trattamenti sanitari. Il testo di base è la legge 219/2017 (c.d. legge sul consenso informato) che all’art. 1 prevede:
    - che il consenso informato del paziente deve essere raccolto in forma scritta o videoregistrata ed inserito nella cartella clinica;
    - che chiunque ha il diritto di rifiutare in tutto o in parte qualsiasi accertamento diagnostico o trattamento sanitario indicato dal medico per la sua patologia o anche singoli atti del trattamento stesso;
    - che chiunque può revocare in qualsiasi momento il consenso già prestato.
    Questi principi valgono per tutte le strutture sanitarie (ospedali, cliniche, ambulatori, studi medici, RSA ecc.) e si applicano a tutti, pazienti e visitatori.
    Pertanto, l’eventuale rifiuto di un medico di prestare assistenza sanitaria a chi non voglia indossare una mascherina o sottoporsi al test PCR è semplicemente un reato. Il reato in questione è quello di violenza privata (art. 610 c.p.) che punisce con la reclusione fino a quattro anni chiunque, con violenza o minaccia, costringe altri a fare, tollerare od omettere qualche cosa. È importante ricordare che il reato è perseguibile a querela di parte e che, quindi, occorre denunciare i medici o i responsabili delle strutture sanitarie entro il termine di tre mesi dal fatto.
    Non dimentichiamo che i medici che ancora insistono con i tamponi e le mascherine sono gli stessi che hanno aderito entusiasticamente al protocollo di paracetamolo e vigile attesa ed hanno collaborato alla campagna di inoculazione del siero genico sperimentale.
    Non ci possono essere né perdono né comprensione per coloro che si sono macchiati di simili abominevoli crimini contro l’umanità.
